Dealing With Police In The UK

If police approach us, it is a good idea to start filming their name badge and shoulder number and then continue filming the interaction and ask them "may i see your warrant card?"

If they refuse, just repeat "may i see your warrant card?"

If they refuse again, say "i require to see your warrant card immediately under Section 90 of The Police Act 1996 which stipulates you MUST show it if a member of public requests it."

If they try to say you're not allowed to film them, then ask them "are you willing to swear to that under penalty of perjury?" If they say yes, then say "brilliant! What's your name and address?"

Police powers of arrest: your rights
To arrest you, the police need reasonable grounds to suspect you're involved in a crime for which your arrest is necessary.
The police have powers to arrest you anywhere and at any time, including on the street, at home or at work.
The police arrest procedure
If you're arrested the police must:
- identify themselves as the police

- tell you that you're being arrested

- tell you what crime they think you've committed

- explain why it's necessary to arrest you

- explain to you that you're not free to leave
If you're under 18 the police should only arrest you at school if it's unavoidable, and they must inform your headteacher.
The police must also contact your parents, guardian or carer as soon as possible after your arrival at the police station.
Police powers to use reasonable force
If you try to escape or become violent, the police can use 'reasonable force', for example holding you down so you cannot run off.
You can also be handcuffed.
The police have powers to search you when you're arrested.

So it's best not to run away from police, as you could then possibly be arrested for fleeing the scene of a crime, or for resisting arrest. But let's put it this way, you're probably not making it better for yourself, you'll just be making yourself look guilty, and you probably won't get far anyway, especially since there are CCTV cameras everywhere these days, so even if you escape, that just means they'll be looking for you and may even come straight to your house if you've done something wrong...

And even if you think you haven't, there are better ways of dealing with the police. For example, if you look at the information about police powers of arrest from the government website, it says that they must explain why you're not free to leave and to explain what crime you're suspected of. So, if I wanted something to say, bearing in mind what I have already explained on my conditional acceptances page, I'd ask them a question. Here are two examples of questions i personally would ask:

1. Are you detaining me or am I free to go.

2. What crime am i  suspected of committing? I'd only use the 2nd question if the answer to the first question is "you are being detained" or something very similar. If they give me any other answer or avoid answering the first question I would simply repeat it over and over again or however many times it takes them to tell me that i'm free to go. If they say they want to search me after saying they're detaining me i'd tell them that i don't consent to be searched, because then if they search me without my consent after that, anything they find can't be used as evidence and can be thrown out of court, possibly unless it is done at the police station after being arrested for a crime. But I still wouldn't commit a crime in the first place, because a crime is causing someone damage, loss or harm and committing fraud. Other than that is just breaking of a rule, but once again, i reiterate here, this is not an excuse to go around acting irresponsibly, because the only way to use this knowledge correctly and honourably is by being responsible for our own actions, because if we're not, then sooner or later we will cause someone harm and then we'll be in big trouble and none of this knowledge will be able to protect us, because this is exactly what this knowledge is for, to be able to hold those who seek to do us harm accountantable. So we obviously don't want to become one of those people accidentally by acting irresponsibly.

The Right To Counsel

A better way to go about things may be to say "my solicitor [or attorney/lawyer in America] said i don't have to give you any information without him/her present [or without counsel]"

So that means, after you have shown them your licence and insurance [registration in America], or better still, your passport, you don't say anything else, not even your name. Because as they say, what you say can and will be used against you in a court of law. So don't give any details, and no signature etc without your solicitor present, plus your name is on your ID anyway. Making statements is giving evidence, so only ask questions and only if they press you further. For instance they may threaten to arrest you, you can repeat "did you not hear me when i said my solicitor/lawyer told me not to give you any information without them present?" Or, "do you not remember what i just said about having my solicitor/lawyer present?"
Take a look at my 'Conditional Acceptances' page, in the ibdex for a further in depth explanation of this.
