How To Pay For Utilities With A Signature

As we know, there is no money of substance anymore, owing to a fiat currency being put into place across the globe (unless you believe Earth is flat, in which case mind you don't fall off the edge, lol), so there is only paper or digital money. Go back and read the previous page on A4V and my page about money, before reading this page, for a better explanation and to give you a better understanding, if you need to. But you just need to know, that because of the bankruptcy (1931 in England and 1933 in America), most things are prepaid. This page is about the method of paying for utilities that Paul Webster has so kindly shared with us all. 

Enforcement Of This Remedy

Before we get to the actual process for this remedy, I must say although that it will most likely not need to be enforced in a court before the utility company will back down, there is a possibility of this. But rest assured, if it happens, which in my case it didn't, you'll more than likely only need to do it once, or maybe twice if they refer it to a higher court, but it should be easy, and need not be repeated once you've completed the process. Although they'll probably employ other tactics to scare us, like putting armed police next to us in court. The reason for armed police is that the only reason they can have to stop you, is by telling the court you're a terrorist or a madman/woman, who intends to blow up the street with your gas supply, or something like that, see below. 

Warrants Of Entry 

A trick utilities companies will try to use, is applying from the court for a warrant of entry. This is just a scare tactic, they are just trying to scare you into paying, because if we look at the legislation regarding warrants of entry, which is the Rights of Entry (Gas and Electricity Boards) Act 1954 as shown here:

"Warrant to authorise entry.

(1)Where it is shown to the satisfaction of a justice of the peace, on sworn information in writing,-

[F1(a)that admission to premises specified in the information is reasonably required by a gas operator or an electricity operator or by an employee of a gas operator or an electricity operator;]

then subject to the provisions of this section the justice may by warrant under his hand authorise [F4the operator or [F3any employee of the operator]], as the case may be, to enter the premises, if need be by force.

(b)that admission to the premises for that purpose was sought in a case of emergency and was refused by or on behalf of the occupier; or

(c)that the premises are unoccupied; or,"

We can see, that they are only allowed to gain entry if there is some form of emergency in other words if there is danger, like a gas leak for instance. Monetary disputes do not give the right of entry, so, unless you don't turn up in court, you can simply have this thrown out of court by asking the following simple question "what can they gain entry for?" This means they can't fit a pay as you go meter or smart meter without your permission. 

The Process For This Remedy

(5) This section does not apply where the regulated agreement is a non-commercial agreement"

(1) Where a cheque is crossed and bears across its face the words "account payee" or "a/c payee", either with or without the word "only", the cheque shall not be transferable, but shall only be valid as between the parties thereto."

"an unstamped document cannot be relied upon nor can it be used for legal purposes. The effect of Stamp Act 1891/S14(4) is that an unstamped document cannot be used for legal purposes (except as evidence in a criminal action) if it is executed in the UK or if it relates to property in the UK or anything done or to be done in the UK such as registration of a transfer of ownership by a Company Registrar. Under Section 14(4) a document is not "duly stamped" unless it has been stamped with the proper stamp duty...

It is sometimes remarked that the assessment and stamping of a document is provisional unless and until it is formally adjudicated under the terms of Stamp Act 1891/S12 (see STSM012020)... 

In practice, Company Secretaries, Public Servants and generally all persons having responsibility for recording and registering documents are prepared to accept the assessment of Stamp Taxes without the need for formal adjudication unless it is specifically required by legislation."

Now for the actual process, first of all we'll need to phone up our utility company to ask for an invoice or bill to be sent to us, so that we receive one with a giro credit [payment] slip at the bottom. Best to double check it'll have this payment slip on it when you speak to them on the phone.

The Giro Slip

Secondly, once we receive the giro slip, we'll need to put either 3 or 1, 1st class postage stamp(s) on the front of the statement/top part of the bill, just above the tear off/"please detach here" part and write your name through it/them and the date of writing (or just sign and date through each one) at a 45° angle, see the following picture:

Thirdly we want to glue another piece of paper to the back of the giro slip with the writing as in the following picture:

So, you should be able to see that we have affixed another stamp, above the tear off slip, in the first available space, as close to the giro slip as possible. Then we have written the following on a piece of paper which we again glued to the back of the giro slip:

To________ (this is where the name of the utility company goes, for example, BRITISH GAS

Transferred by ________ (this is where the account holder/customer's name goes) 

Of___________ (account holder's address) 

N. I. No._________ (Account holder's National Insurance number) 

Endorsed by: ________ (Account holder's name) 

Dated________ (date of writing) 

If Your Supplier Refuses To Send A Giro Slip

No problem there, I just created my own when I had that situation. Simply add the essential elements on to a piece of paper. It's your signature/endorsement which is the important part after all, as this holds and conveys the value.

What I also included, along with the copy of Notice of Removal of implied Right of Access above was a copy of:
section 123 of the Consumer Credit Act 1974 (see section 5);
The Rights of Entry Act 1954;
an exerpt about stamp duty, but really it should be the Stamp Act, or relevant sections. And that's basically it, although i did send a notice of payment by endorsement with my payment have some visits from debt collectors the utility company apparently had working for them, although to me that just means they have set up an agreement with them that they deal with all their debts, so it's the same as if they've sold the debt on to a debt collector; if they bought the debt the debt is paid (this particular debt collector even committed fraud by printing out a fake warrant and it seems they were used to intimidating people as there were 3 of them, but let's just say I wasn't intimidated to cut a long story short). But they had previously sent me forms to fill out pertaining which court i would like to attend tobsettle the matter, and they listed courts all over the country, mostly near to where their company was based, and only one in London, so ignoring the form, I wrote back detailing my nearest courts, but never heard back, this is when they showed up at my door. But the important thing to note here is that my annual gas safety check is part of my tenancy, so the utility company can't apply to a warrant from a judge on the grounds of safety. If I was in the situation where my utility company were the ones doing the annual gas safety check though, I'd most probably wait until just after mine had been completed for that year before I do this process, just so they can't really use that to gain a warrant from the judge. Although I have been told by somebody else in my Telegram group that they tried to do this process and got a visit from the National Grid who then turned her electricity off for a couple of months. So in ending all i can say is be cautious if you decide to attempt something like this and prepare yourself thoroughly first, not least by understanding conditional acceptances (see my page with that title).
